Seafood is one of the most nutritious and globally traded foods, but it also carries unique risks—histamine poisoning from scombroid species, Vibrio in raw shellfish, parasites in wild-caught fish, and chemical contaminants. To protect consumers, the U.S. Food and Drug Administration (FDA) made Seafood HACCP mandatory in 1997. This science-based, preventive system remains the cornerstone of seafood safety regulation today.

Regulatory Foundation: 21 CFR Part 123

The FDA’s Seafood HACCP regulation is codified in 21 CFR Part 123 – Fish and Fishery Products.

  • Published: December 18, 1995 (final rule)

  • Effective: December 18, 1997

  • Scope: Applies to all “processors” (domestic or foreign) of fish and fishery products whose products enter U.S. interstate commerce.

Key definitions:

  • Processor: Anyone who handles, stores, prepares, heads, eviscerates, shucks, freezes, manufactures, preserves, packs, or labels fish/fishery products.

  • Fish/Fishery Product: Includes finfish, crustaceans, mollusks, and products where fish is a characterizing ingredient.

  • Importer: The U.S. owner/consignee or agent responsible for ensuring compliance at entry.

Exemptions (narrow):

  • Pure harvesting or transport without further processing

  • Retail establishments selling directly to consumers

  • Certain onboard vessel activities (heading/eviscerating/freezing solely for holding)


The regulation works alongside Current Good Manufacturing Practices (CGMPs) in 21 CFR Part 117 (Subparts A, B, and F apply to seafood processors; Subparts C and G are largely exempted if you comply with Part 123).


FSMA Note: The FDA Food Safety Modernization Act (2011) explicitly preserved Seafood HACCP as an equivalent preventive control system.


Core Regulatory Requirements for Processors

Every covered processor must:

  1. Conduct a Hazard Analysis (§123.6(a)) Identify biological (pathogens, parasites), chemical (histamine, toxins, mercury, aquaculture drugs), and physical hazards that are “reasonably likely to occur.”

  2. Develop and Implement a Written HACCP Plan (§123.6(b)–(c)) The plan must be specific to each product and processing location (or group similar products). It lists:

    • Hazards

    • Critical Control Points (CCPs)

    • Critical limits

    • Monitoring procedures (what, how, frequency, who)

    • Corrective actions

    • Verification procedures

    • Record-keeping system

  3. Implement Sanitation Control Procedures (SSOPs) (§123.11) Monitor 8 key sanitation areas (water safety, food-contact surfaces, cross-contamination prevention, etc.) and correct deviations.

  4. Training Requirement (§123.10) At least one person must be trained in HACCP principles specific to seafood (FDA-recognized Seafood HACCP Alliance curriculum or equivalent experience). This person handles plan development, reassessment, and record reviews.

5.  Records & Verification (§123.8–123.9)

  1. Retain records 1 year (refrigerated) or 2 years (frozen/shelf-stable).

  2. Annual plan reassessment (or sooner if changes occur).

  3. Trained individual must review monitoring, corrective-action, and calibration records promptly.

6. Corrective Actions (§123.7) Pre-determined procedures to segregate product, prevent adulterated food from entering commerce, and fix the root cause.


Special Subparts:

  • Smoked/smoke-flavored products: Additional controls for Clostridium botulinum toxin (§123.15–16).

  • Raw molluscan shellfish: Source controls and tagging requirements (§123.28).

Special Rules for Importers (§123.12)

U.S. importers must verify that foreign processors comply with Part 123. Requirements include:

  • Written verification procedures

  • Product safety specifications

  • One affirmative step per shipment or continuing (e.g., obtain foreign processor’s HACCP records, third-party certificates, on-site inspections, lot testing, or written guarantees)


Records must be in English and available for FDA review. Failure triggers Import Alerts.


How to Implement a Seafood HACCP Plan – Step-by-Step

The FDA’s Hazards & Controls Guidance outlines an 18-step process, but it boils down to:

Preliminary Steps (before applying the 7 principles):

  1. Assemble a HACCP team (include at least one trained person).

  2. Describe the product, distribution, and intended use.

  3. Develop and verify a process flow diagram (on-site walk-through).

Apply the 7 Principles:

  1. Conduct hazard analysis (use the FDA Guide tables).

  2. Determine CCPs (use decision tree if needed).

  3. Establish critical limits (e.g., internal temp ≥145°F/63°C for cooking, histamine <50 ppm).

  4. Establish monitoring procedures.
