FDA Food Code: Key Changes from 2017 to 2022

The FDA Food Code serves as a model to guide uniform standards for food safety across retail outlets and food service establishments and, depending on the state, manufacturing operations.

It is periodically updated to reflect new scientific knowledge, emerging food safety issues, and changes in food preparation and consumption trends. The transition from 2017 to the 2022 edition of the FDA Food Code marks significant advancements in food safety regulation and consumer protection. Here's an overview of some of the pivotal changes and new additions to the code.

 

Embracing New Definitions and Standards

One of the notable changes is the amendment of definitions to align with current food safety practices. For instance, the term "Certification Number" has been revised to encompass all certification and permit codes found on shellfish tags or labels. This change ensures greater traceability and safety in shellfish consumption. Additionally, the definition of "Intact Meat" has been clarified, stating that beef products vacuum tumbled with solutions are not considered intact meats.

 

The FDA Food Code 2022 has introduced amendments that include the term "tobacco products" in its regulations. Specifically, sections 2-301.14(D) and 2-401.11 have been updated to reflect this change. The inclusion of tobacco products aims to enhance the safety and protection of food offered at retail and in food service by addressing the risks associated with tobacco use in these settings.

 

Handwashing Temperature

The 2022 Food Code has indeed updated its guidelines regarding the minimum temperature for warm water used to wash hands. The amendment specifies that handwashing sinks must be capable of delivering running water at a minimum temperature of 85°F (29.4°C). This change reflects the FDA's commitment to maintaining a uniform system that ensures food safety and protection, accommodating both public health requirements and practicality for food service employees. Addressing Allergens

In response to the growing awareness and incidence of food allergies, the FDA Food Code has expanded its list of major food allergens to include sesame, effective from January 1,

2023. This addition reflects the recognition of sesame as a significant allergen and aligns with the Food Allergy Safety, Treatment, Education, and Research (FASTER) Act of 2021. In addition to this, there is a lot more emphasis on training associates in food allergy awareness. Employee allergen training must now include the ability to not only identify major food allergens but also knowing and being able to recognize the symptoms of an allergic reaction and how to handle this potentially life-threatening experience. There is a lot of additional information included such as effective communication with guests on their allergens transferring this to the staff and emphasizing techniques needed to prevent cross contact between allergen containing products and non-allergenic products. 

 

Enhancing Food Donation Safety

To combat food waste and ensure the safe donation of food, the 2022 Food Code has clarified regulations surrounding food donations. It stipulates that food stored, prepared, packaged, displayed, and labeled according to Food Code safety provisions can be donated. This change is expected to facilitate the donation process while maintaining food safety.

 

Updating Food Safety Management

The new code emphasizes active managerial control and risk-based inspections. These updates aim to provide a more standardized approach to inspections and audits of food establishments, thereby reducing the risk of foodborne illnesses.

 

Modernizing for Accessibility

In keeping with federal mandates, the FDA has made several edits to the Food Code to meet web accessibility requirements under Section 508 of the Rehabilitation Act of 1973. This ensures that the Food Code is accessible to all users, including those with disabilities.

 

We have only touched on a few of the changes from 2017 to the 2022 FDA Food Code which overall reflect a commitment to public health and consumer safety.  By updating definitions, addressing allergens, clarifying food donation guidelines, and enhancing food safety management, the FDA continues to adapt to the evolving landscape of food safety. Stakeholders in the food industry are encouraged to familiarize themselves with these changes to ensure compliance and to protect public health.
